IMPACT OF BREXIT ON U.S. ALCOHOL INDUSTRY

We have received a number of questions regarding the impact of the United Kingdom’s (UK) referendum to leave the European Union. This referendum, popularly known as Brexit, currently does not change the United States' trading relationship with the UK. However, we will post guidance to address any future changes that affect the industries we regulate. If you have additional questions, please contact the Office of the United States Trade Representative.

DISASTER CLAIMS – DAMAGE DUE TO SEVERE STORMS, FLOODING, LANDSLIDES, AND MUDSLIDES IN WEST VIRGINIA

On June 25, 2016, the President declared a major disaster in West Virginia due to severe storms, flooding, landslides, and mudslides beginning on June 22, 2016, and continuing. (See Additional Information from FEMA section below for a map of affected counties and other related resources.)

Under various circumstances, including when the President has declared a major disaster, we allow alcohol and tobacco businesses to file claims with us for the payment (refund or allowance of credit) of federal excise taxes paid on beverage alcohol or tobacco products lost, rendered unmarketable, or condemned by a duly authorized official.

FDA ISSUES PRIOR NOTICE OF IMPORTED FOOD QUESTIONS AND ANSWERS (EDITION 3)

"Prior notice" is notification to the FDA that an article of food, which includes alcohol beverages, is being imported or offered for import into the United States in advance of the arrival of the article of food at the U.S. border.

The Food and Drug Administration is announcing the availability of guidance for industry that provides updated information pertaining to prior notice of imported food under the Federal Food, Drug, and Cosmetic Act (the FD&C Act), as amended by the Food Safety Modernization Act (FSMA). The guidance is intended to help the food industry and others comply with prior notice requirements.
