Greetings! This week’s top news includes announcements that we've published additional guidance at TTB.gov related to the Craft Beverage Modernization and Tax Reform Act, registration is now open for upcoming TTB trade practice seminars, TTB conducted a joint operation with agents from the California Department of Alcoholic Beverage Control into alleged prohibited trade practices, and two arrests were made in a criminal case related to tobacco excise tax.

NEW CRAFT BEVERAGE MODERNIZATION AND TAX REFORM GUIDANCE AVAILABLE

We recently published additional Craft Beverage Modernization and Tax Reform guidance. The new guidance addresses certain issues related to eligibility for the tax credits/reduced tax rates on wine, distilled spirits, and beer, including issues relating to transfers in bond.

REGISTRATION IS OPEN FOR TTB TRADE PRACTICE SEMINARS

Have you ever wondered why TTB keeps mentioning “pay to play” when we’re talking about unlawful trade practices?  Are you concerned that you may be operating in violation of the “tied-house” rules?  Should you be concerned?  What exactly are “consignment sales” anyway?

Come learn all this and more as TTB presents half-day Trade Practice Seminars geared towards alcohol beverage industry members or their representatives. During these seminars we will discuss laws, regulations, and enforcement efforts to prohibit certain alcohol marketing practices that are deemed to cause unfair competition.

Officials from the applicable state regulatory agencies will also be there to talk about trade practice enforcement from their state’s perspective.

TTB AND CALIFORNIA AUTHORITIES CONDUCT JOINT TRADE PRACTICE INVESTIGATIONS

This week, TTB conducted a joint operation with agents from the California Department of Alcoholic Beverage Control into alleged prohibited trade practices in Napa and Sonoma Counties.

The focus of this TTB investigation is on consignment sales arrangements, which, like other unlawful trade practices, are used to gain an unfair advantage over law-abiding industry members and ultimately limit consumer choice.

TWO ARRESTED IN SCHEME TO DEFRAUD U.S. BY AVOIDING PAYMENT OF FEDERAL EXCISE TAXES ON CIGARETTES

On Thursday, February 22, 2018, Yong “David” Lu, 54, of Arcadia, and Wenzhu Guo, also 54, of Monterey Park, California were arrested by federal authorities on charges of scheming to avoid payment of federal excise taxes on duty-free cigarettes that should have been sent abroad, but instead were diverted to local retail outlets.
