Greetings! This week’s top news includes how to avoid one of the most common reasons why we send alcohol beverage labels back for correction, two recently accepted tax-related and one trade practice-related offers in compromise, registration information for our May 28 wine formula basics webinar, and encouragement for DSP proprietors to view our distilled spirits proofing videos.

AVOIDING COMMON ERRORS ON COLA APPLICATIONS - PROVIDING TRANSLATIONS OF FOREIGN TEXT

One of the most common problems we see on applications for label approval (COLAs) that causes us to have to send them back for correction is that the label contains foreign text but the applicant didn’t supply a translation.

If a label contains foreign text, we must ensure that it’s not misleading or prohibited, and that it doesn’t conflict with mandatory label information. The most efficient way for TTB to evaluate foreign text is for the applicant to provide a translation.

TTB ACCEPTS TWO TAX-RELATED AND ONE TRADE PRACTICE-RELATED OFFERS IN COMPROMISE

We accepted a $20,000 offer in compromise from Heritage Tobacco LLC, and a $125,000 offer in compromise from LFS, Inc. for allegedly failing to timely file excise tax returns and pay excise tax.

We also accepted a $420,000 offer in compromise from Crown Imports LLC for alleged trade practice violations.

Distilled spirits plant proprietors are required to determine taxes owed on spirits removed from their bonded premises. To do this, proprietors must "gauge" the spirits, that is, determine the quantity and proof of the spirits.
